1. Introduction​

Welcome to 『雲端貓居 NyankoHost』(the "Service"), a free Discord bot hosting service provided by SleepyNeko Studios Ltd. ("we", "our", or "us"). These Terms of Service (the "Terms") govern your access to and use of the Service, including any related websites, APIs, dashboards, and documentation.

By using the Service, you agree to be bound by these Terms. If you do not agree, you must not use the Service.

You may only use the Service if you:

  • Are at least 13 years old (or the minimum age of digital-consent in your region), and
  • Have the authority to represent an organization if you use the service on its behalf.

2. Compliance With Policies​

All users are required to comply with:

Our Service depends on third-party platforms (e.g., Discord) and infrastructure providers. We do not control, and are not responsible for, their availability, terms, policies, or actions.

Your use of Discord and any other third-party service is governed solely by their respective terms and policies. If Discord or another third party suspends or restricts your account or bot, this may affect your ability to use our Service, and we are not liable.

3. Description of the Service​

The Service provides free hosting for Discord bots, including (but not limited to):

  • Running user-provided Discord bot code or containers
  • Providing limited compute, memory, network, and storage resources
  • Optional tooling such as logs, metrics, control panels, and auto-restarts

The Service is provided "as is" and "as available", with no uptime guarantee, no data durability guarantee, and no guarantee of uninterrupted operation.

We may change, suspend, or discontinue any part of the Service at any time, with or without notice.

4. Your Account and Security​

4.1 Account Responsibility​

You are responsible for:

  • Maintaining the confidentiality of any API keys, control panel logins, and credentials
  • All activities that occur under your account, Discord server, or bots hosted with us

You must notify us promptly if you suspect unauthorized access to your account or bot.

4.2 Account Eligibility​

We may refuse service, close accounts, or reclaim usernames at our discretion, subject to applicable law.

5. User Responsibilities​

5.1 Ownership and Rights​

You retain any rights you hold in the code and content you upload or connect to the Service ("User Content").

You represent and warrant that:

  • You own or have full rights to all code, assets, libraries, and content used in your Discord bot.
  • You have obtained all licenses or permissions necessary to use third-party materials.
  • Your bot does not infringe on the intellectual property rights of others.

5.2 License to Us​

By using the Service, you grant us a non-exclusive, worldwide, royalty-free license to:

  • Store, run, and process your bot and related data as necessary to provide the Service
  • Generate and retain logs and metrics related to your usage

We do not claim ownership over your code or your bot.

5.3 Your Responsibility​

You are solely responsible for:

  • Ensuring you have all rights and permissions to use and host your bot and content
  • Compliance with Discord’s terms and policies
  • Any interactions your bot has with third-party users and servers

We are not responsible for your bot’s behavior.

6. Acceptable Use​

6.1 NSFW Content Restrictions​

If your bot interacts with or displays NSFW (Not Safe For Work) content, you must ensure:

  • Your bot correctly marks and restricts NSFW content in compliance with Discord’s NSFW rules
  • NSFW content is never exposed to users who did not explicitly opt in
  • NSFW commands cannot be invoked in channels where such content is not allowed
  • NSFW content is not exposed to minors under applicable local laws

Failure to properly restrict NSFW content may result in immediate suspension.

6.2 Resource Usage​

We may impose or adjust limitations on:

  • CPU, RAM, storage, and bandwidth
  • Number of bots, shards, or guilds per account
  • Maximum concurrent connections or requests
  • Logging and log retention

Users may not:

  • Consume or saturate allocated resources (CPU, RAM, storage, network) at continuous or abusive levels, even if technically available
  • Run workloads designed to occupy maximum CPU or RAM continuously
  • Use the Service for unrelated high-resource tasks (e.g., cryptomining, AI training, video rendering)

Example: even if your bot can use up to 100% CPU, using 100% CPU 24/7 is considered abuse.

These limitations are detailed in our Fair Usage Policy and may be updated from time to time. We may throttle, temporarily suspend, or terminate your access if you exceed these limits or if your usage negatively affects Service stability.

6.3 Prohibition on Multiple Accounts​

Each individual may maintain any number of membership accounts. However only one account may be used to obtain resources.

You may not:

  • Create multiple accounts to bypass limits
  • Create accounts for others to circumvent restrictions
  • Share accounts with unrelated individuals
  • Use automation to mass-create accounts

If we detect alternate accounts ("alts"), we may suspend all related accounts.

7. Suspension and Termination​

We may suspend or terminate your access to the Service, with or without notice, if:

  • You violate these Terms or the Fair Usage Policy
  • Your usage poses a security, stability, or legal risk
  • We stop offering the Service

Upon termination:

  • Your right to use the Service ends immediately
  • Your hosted instances may be stopped and data may be deleted irreversibly
  • Certain sections of these Terms (e.g., disclaimers, limitations of liability) will survive

You may stop using the Service at any time. If you wish to fully close your account, please contact us with the methods stated in the later sections.

8. Data Retention and Backups​

The Service is not intended as a backup service.

  • We may delete your data (including containers, files, and logs) at any time after suspension, termination, or prolonged inactivity.
  • We do not guarantee that any data will be retained or recoverable.

You are solely responsible for keeping backups of your code and important data.

9. Disclaimers​

To the maximum extent permitted by law:

  • The Service is provided "as is" and "as available"
  • We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement
  • We do not warrant that the Service will be uninterrupted, secure, or error-free, or that data loss will not occur

You understand and agree that you use the Service at your own risk.

10. Limitation of Liability​

To the maximum extent permitted by law:

  • We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, lost data, or business interruption, arising out of or relating to your use of the Service
  • Our total aggregate liability to you for any claims arising out of or relating to the Service or these Terms shall not exceed the greater of (a) £50 or (b) the amount you paid us in the last 3 months; for free services, this would typically be £0

Some jurisdictions do not allow certain limitations; in such cases, the above limitations apply to the fullest extent permitted.

11. Indemnification​

You agree to indemnify and hold harmless SleepyNeko Studios Ltd., its directors, officers, employees, and contractors from any claims, damages, liabilities, or expenses (including reasonable legal fees) arising out of:

  • Your use of the Service
  • Your User Content or bots
  • Any breach of these Terms or violation of applicable law

12. Changes to These Terms​

We may update these Terms from time to time. When we do, we will revise the "Last updated" date at the top of this page.

If changes are material, we may provide additional notice (such as via email, dashboard, or announcement). By continuing to use the Service after changes become effective, you agree to the updated Terms.

13. Governing Law and Dispute Resolution​

These Terms are governed by the laws of England and Wales, without regard to conflict of laws principles.

Any disputes arising out of or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of England and Wales, unless mandatory law requires otherwise.
